Terms of Service

1. System Purpose

CrowdCheckr provides a computer vision system that estimates venue occupancy by counting entries and exits at a monitored doorway and displaying that data through a web app. The system is provided for informational and decision-support purposes only.

The system is not:

  • A fire code compliance system
  • A certified occupancy counter
  • A safety or life-safety device

Counts may be inaccurate due to lighting conditions, crowd movement, obstruction, network issues, or other environmental factors.

2. Installation

By agreeing to a CrowdCheckr installation, the venue authorizes CrowdCheckr to install a camera and related hardware near an entrance. The venue agrees to provide access to the installation location, one power outlet, and Wi-Fi connectivity.

Installation may require drilling mounting holes. The venue acknowledges that installation may leave permanent holes or minor cosmetic wall damage after removal and accepts responsibility for any wall repairs.

3. Venue Responsibilities

The venue retains full responsibility for:

  • Determining and enforcing occupancy limits
  • Training staff and managing crowd safety
  • Complying with all applicable fire, safety, and liquor laws
  • All operational decisions at the venue

The venue acknowledges that CrowdCheckr data may be inaccurate and agrees that staff observation and venue procedures must be relied upon for operational decisions. CrowdCheckr data must not be relied upon as the sole basis for safety or compliance decisions.

4. Data & Privacy

CrowdCheckr collects occupancy analytics including entry counts, exit counts, and timestamped occupancy totals. The system does not perform facial recognition or identify individuals.

5. Equipment

All hardware installed at the venue remains the exclusive property of CrowdCheckr, LLC. The venue agrees to protect the equipment and allow access for maintenance or removal.

6. Termination

Either party may terminate service with 30 days written notice. During a pilot period, either party may terminate with 48 hours notice. Upon termination, the venue agrees to allow CrowdCheckr access to remove all installed equipment.

7. Disclaimer & Limitation of Liability

The CrowdCheckr system is provided "AS IS" and "AS AVAILABLE." CrowdCheckr makes no warranties, express or implied, including warranties of accuracy, reliability, or fitness for a particular purpose.

To the maximum extent permitted by law, CrowdCheckr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Personal injury or death
  • Property damage
  • Regulatory penalties or fines
  • Fire code violations
  • Loss of business or revenue
  • Incidents related to venue occupancy or crowd management

After any pilot period, CrowdCheckr's total aggregate liability under this Agreement shall not exceed the total amount paid by the venue during the twelve (12) months preceding the claim.

8. Indemnification

The venue agrees to defend, indemnify, and hold harmless CrowdCheckr, LLC and its members, employees, and agents from any claims, damages, liabilities, or legal expenses arising from venue operations, crowd management decisions, regulatory compliance, or any incident occurring at the venue.

9. Governing Law

This Agreement shall be governed by the laws of the State of Wisconsin.
